Online Banking Agreement and Disclosure

This agreement between you and Antioch Community Federal Credit Union (“we” or “us” or “ACFCU”) contains the terms, conditions and disclosures of Online Banking. Online Banking allows you to access your share and checking accounts, loans, and lines of credit and you are subject to the rules and regulations governing the general use of those accounts.

You will need to use certain types of computers, obtain an Internet account, and use compliant browser software to use Online Banking. The installation, maintenance, and operation of those items are your responsibility. We are not responsible for any errors or failures of your computer equipment or Internet connection software. Online Banking can be used at any time, 24 hours a day; however, certain system maintenance or malfunctions may make it unavailable at times.

Use of Online Banking is subject to terms of ACFCU’s account agreement and other such terms, conditions and requirements as the Credit Union may establish from time to time.


You may perform the following functions with your accounts using Online Banking:

1.      Obtain account balances and transaction information from your designated accounts.

2.      Obtain loan payment amount, due date, and payoff information.

3.      Make loan payments.

4.      Transfer funds between your designated shares, checking and loans.

5.      Transfer funds to or from your account to or from the savings or checking account of another ACFCU member after setting up cross link access.

6.      View account history.

7.      Download account information from your designated accounts into financial management software.

8.      Retrieve and print copies of cancelled checks.

Completed transactions are “real time” and affect your account immediately.


A Password is used for your protection. You agree to:

1.      Not disclose your password or otherwise make it available to anyone else.

2.      Use the password as instructed.

3.      Promptly notify ACFCU of any loss or theft of the password.

4.      Be liable of the password and for its authorized use as described in this account agreement and disclosure.


At the time you sign up for Online Banking, your password will be the last four digits of the primary?s social security number. You will be required to change your password for Online Banking. Your new password must be at least 4 characters long. For your security, your password cannot be any part of your social security number, address, telephone or other numbers, which could be easily deciphered by another person.


We may at any time, and at our sole discretion, limit or cancel the Online Banking we offer you. Specifically, we reserve the right to cancel access to Online Banking if services have been abused in any way. 


There are no fees for Online Banking at this time. ACFCU reserves the right to initiate fees at any time upon proper notification to you. You will be given at least thirty (30) days advance notice before ACFCU implements any charges or fees for any Internet account access related services.


If you believe your password has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, notify us IMMEDIATELY at 925-757-1320 during normal business hours. We cannot accept notification of lost or stolen passwords or unauthorized transfers via E-mail. If you notify us within two (2) business days after you learn of the loss or theft, your maximum liability is $50.00.

If you do NOT notify us within two (2) business days after you learn of the loss or theft of your password, and we can prove that we could have prevented someone from using your password if you had told us in time, your maximum liability is $500.00.

If your Statement contains payments and/or transfers that you did not make, notify us IMMEDIATELY. If you do not notify us within sixty (60) days after the Statement was mailed to you, you may not get back any of the money you lost if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a hospital stay or a long trip) prevented you from telling us, we may at our discretion, extend the time.

If any unauthorized use of your password occurs, you agree to (1) cooperate with us and appropriate law enforcement authorities in identifying and prosecuting the perpetrator; and (2) provide reasonable assistance requested by us in recovering any unauthorized transfer of funds.


In case of error or questions about Online Banking call us at 925-757-1320 or write us at Antioch Community Federal Credit Union, 301 G Street, Antioch, CA 94509 if you think your statement is wrong; or if you need information about a transfer listed on the statement. We must hear from you no later than sixty (60) days after we send the first statement on which the problem or error appeared.

1.      Tell us your name and account number.

2.      Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.

3.      Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days.

We will tell you the results or our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or questions. If we decide to do this we may re-credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within ten (10) business days, we may not re-credit your account.

If we decide that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation and your account will be adjusted accordingly. You may ask for copies of the documents that we used in our investigation. 


Except as otherwise provided in the Agreement or by law, we are not responsible for any loss, injury, or damage, whether direct, indirect, special or consequential, caused by the Online Banking or the use thereof or arising in any way out of the installation, operation, or maintenance of your PC equipment.


Member, in consideration of being allowed access to the Online Banking, agrees to indemnify and hold the Credit Union harmless for any losses or damages to the Credit Union resulting from the use of the Online Banking, to the extent allowed by applicable law.


We may change our Bylaws and any terms of this Agreement. We reserve the right to amend, modify, add to, or delete from the terms or conditions of this Agreement without prior notice, except as required by law. A change may include a change to existing account terms, a change that involves new account terms, and a change that involves the addition of new terms or conditions not otherwise contemplated by you or us at the time you received this Agreement. Any change will take effect immediately, unless stated otherwise in any notice we send you. Your use of the Services following receipt of such notice constitutes acceptance of such alterations or amendments.


This provision contains the terms of how a dispute between you and the Credit Union will be resolved. Please read this provision carefully since it specifically limits your rights in the event of such dispute. By this provision, at the request of you or the Credit Union, disputes must be resolved by arbitration. Arbitration is a means of having an independent third party resolve a dispute without using the court system. With arbitration, there is no right to appeal the decision of the arbitrator as there is normally in the court system. By this Agreement, you understand that each of us is waiving the right to a jury trial or a trial before a judge in a public court. Either of us may submit a dispute concerning this Agreement to binding arbitration at any reasonable time, notwithstanding that a lawsuit or other proceeding has been commenced. If either of us fails to submit to binding arbitration following a lawful demand, the one who fails to submit bears all costs and expenses incurred by the other compelling arbitration.

Any controversy or claim arising out of or relating to this Agreement, or the accounts covered by this Agreement, will be settled by arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration rules. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. All statutes of limitation and rules of law that would otherwise be applicable to this Agreement, including those provided in the California Commercial Code, shall apply to any arbitration proceeding.

To the extent that there is any variance between the AAA Rules and this Agreement, this Agreement shall control. Arbitrators must have expertise in the substantive laws applicable to the subject matter of the dispute.

You agree to take all steps, and execute all documents, necessary for the implementation of arbitration proceedings.

This arbitration provision supersedes all prior arrangements and other communications concerning dispute resolution as to this Agreement. In the event more than one arbitration agreement entered into by us is potentially applicable to a dispute, the one most directly related to the account or transaction that is the subject of the dispute shall control.


In addition to the foregoing, you agree to be bound by and comply with the requirements of the Account Agreement and Disclosure and applicable state and federal laws and regulations. Your use of the services may also be affected by the Agreements between us for your share, checking, credit card, and loan accounts. In addition, when you link accounts to these services, this does not change the agreements you already have with ACFCU on those accounts. For example, when you use Online Banking to access a credit account, you do so under the terms and conditions we gave you in the Agreement and Disclosure for the credit account. You should review those agreements for any limitations on the number of transfers you can make, and for other restrictions, which might affect your use of an account with the services.

We reserve the right to terminate your use of the services, in whole or in part, at any time without prior notice.

You may cancel your subscription to the services, upon thirty (30) days prior notice to Antioch Community Federal Credit Union. You will be responsible for all payments and/or transfers you have requested prior to termination and for all other charges, fees, and taxes incurred.

Be sure to cancel all outstanding payment and/or transfer orders within the thirty (30) day notification period. We will not be liable for payments and/or transfers not cancelled or made due to your actions related to service terminations.
